Sacramento cracks down on DUIs with funding from recent grant

Police in Sacramento, CA, recently received a grant to help fund DUI enforcement measures. Although beneficial to keep the roadways safe, it is also important to avoid false allegations of drunk driving. Those who believe they were wrongly ticketed should fight the charges.

Sacramento Police recently received a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration (NHTSA) for $183,000. The grant, according to a press release from the City of Sacramento Police Department, is intended to fund efforts to find those who violate driving under the influence, or DUI, laws. The grant will help support DUI patrols and checkpoints as well as Court Sting Enforcement Operations. This will include increased enforcement measures during winter and summer holidays as well as during the Super Bowl, St. Patrick's Day, Cinco de Mayo, Halloween and special local events.

Although it is important to ensure the roadways in California are safe, it is also important to avoid false allegations or violation of a driver's rights. Drivers who receive a drunk driving ticket should take the charges seriously, as harsh penalties can apply.

DUI laws in California

It is illegal in the state of California to operate a vehicle with a blood alcohol content of 0.08 or above. Violation of this law can lead to a variety of criminal penalties, including:

  • License suspension. A driver's license is suspended or revoked for 6 months for a first offense, 2 years for a second and 10 years for a third offense.
  • Mandatory alcohol education, assessment and treatment. Mandatory assessment and treatment are issued for DUI violations. If the driver is under the age of 21 an alcohol education course is also required.
  • Ignition interlock device. Depending on the details of the charges, an ignition interlock device could be required. This is generally mandatory with a third offense.

Depending on the details, imprisonment and vehicle confiscation can also apply. It is also important to note that these penalties can increase in severity depending on the details of the case.

Legal counsel can help

In addition to criminal penalties, those who receive a DUI conviction can also experience long term social stigma. Having a criminal record can make it difficult to find a job, housing and to pursue scholarship opportunities.

It is important for those who are facing these charges to be aware of the fact that defenses are available. Determining which defense is best depends on the details of the case. One aspect of the case that a criminal defense attorney will review is the details of the stop. An attorney will review the stop to ensure that proper procedure was followed. Your attorney will also examine the accuracy of a device used to conduct a breath test, like a Breathalyzer, as well as the procedure used to conduct the test. A violation of any of these procedures could lead to a dismissal of charges.

If you are charged with a DUI, contact a drunk driving defense attorney to help better protect your rights.
